Default Windows Vista?

Ok, im doing a new build. here it is.

http://uk.answers.yahoo.com/question/index;_ylt=ArTr4Wb.HcHqQV3iQvfyI.IgBgx.;_ylv=3?qid =20080708010859AA8aoPW

here is my question.ok, i am currently using a 250GB samsung 8MB buffer HD. Now on that HD is all my games, software, work etc and I have Windows XP 32-Bit OEM installed on that. I want to keep this 250GB hard-drive and want to use at as my MAIN HD on this new build to save the trouble of transferring my stuff, using the 500GB as a second drive.

now since there is already an OS installed i have decided to get Vista HP Upgrade edition EDU

http://www.ebuyer.com/product/124781/show_product_reviews?offset=10&review_type=both&re view_order_by=RUF

Now i have a few questions.

1.) is this an OEM OS??? What i mean is if i install this OS can i upgrade my mobo or will it be tied down
2.) since my current OS is an OEM, if i install this Vista upgrade will this OS become an OEM???
3.) If it isn't an OEM, can i install this on my old computer, then when Vista is installed remove the Hard-Drives and put them in the new the new build???

4.) when Vista is installed over my XP will it delete any of my software, work, games etc??

please help

thanks
Hi katkat, XP will be discontinued soon, meaning there will be no more support/updates etc.
Might as well try Vista, not much money and its for new build btw.

If you install Vista you will have trouble with the drivers. It is safer to stay with XP for the present. I I can't answer the OS/OEM questions, sorry.
